摘要
注释方法、思辨方法、实证方法是目前我国刑法学研究的三种基本方法。注释方法曾长期主导着我国刑法的研究,而在思辨方法提出之后,注释方法开始被冷落,两者在主流与非主流之间进行博弈。思辨方法与实证方法虽分属哲学与自然科学的研究方法,但这无碍于两者间的融洽相处和相得益彰。注释方法与实证方法两者虽是主流与边缘的关系,但是实证方法之价值不可漠视。实际上,随着刑法研究的深化发展,任何一种研究方法不可能独尊一术。因此,综合的方法是最好的方法。
The basic approaches for the present criminal jurisprudence research in China include annotation method,speculation method and empirical method.Annotation method,which had long dominated the research on criminal jurisprudence,was left out after speculation method was developed.They are in the great game between the mainstream and non-mainstream.Speculation method and empirical method,which represent respectively philosophy research method and the natural sciences research method,are unobstructive in their harmonious coexistence.Annotation method and empirical method,being respectively mainstream and marginalized one,no attention should not be paid in the least to the value of the latter.Consequently,it is the best to adopt a comprehensive approach.
