摘要
商品房预售合同签定以后,常常会由于某种原因在房屋竣工交付并办理相关权属证明之前,发生合同主体的变更情况。我国现有法律法规对"楼花"转让问题的规定尚存在缺位现象,围绕这一问题,对楼花按揭合同中的法律关系以及预售合同主体变革涉及的相关法律问题进行了探讨。
After the conclusion of a future commercial apartment contract, many matters will result in the alteration of the parties although the apartment is still unfinished and the rights certificates are unrealized. Regulation on this problem is absent in our legal system. In this article, the writer will analyze some legal issues about this problem.
