摘要
2004年修宪的内容之一就是宣布私有财产受法律保护,国家征收土地和私有财产,应当给与补偿。这一修改,体现了中国人权事业的新发展,对于社会主义市场经济的建设起到极大的推动作用。同时,这一宪法原则的确立,呼唤制定我国的国家补偿法。因此,本文探讨了建立国家补偿制度的现实意义和法理基础,并对制定国家补偿法中的主要问题提出建议。
One of the important contents of the amendment of Chinese constitutional law in 2004 is to proclaim private property is protected by law.It should be compensated when nation levy land and private property.The amendment show the new development of Chinese human rights,and will bring great promotion to socialism market economy.Meaningwhile,this new constitutional princeple call to enact our national compensation act.So this essay studies the realistic significance and theoretic base of national compensation system,and raise my own conceive for national compensation act.
