摘要
以往的刑法理论认为片面共犯缺乏犯意在成员之间的联络而不成立。片面共犯的范围包括片面帮助犯、片面教唆犯和片面实行犯。片面共犯存在有相同于通说意义上的共犯的处罚依据,应当予以处罚。承认片面共犯的理论,可以完善对片面共犯人刑事责任的追究。
In the past half conspiracy has been regarded as failure because of lack of linkage between the conspirators and conspirary intention by the criminal theory.There is reliance by which half conspiracy be relied ,therefore,conspirators should be meritedly punished.It includes aiding conspirator,abetting couspirator and half-doing conspirator.To recognize conspiring theory is conductive to establishment of conspirator's punishment.
