摘要
我国现行劳动争议处理体制存在着诸多弊端,劳动争议调解委员会名存实亡,劳动者维权的第一道防线难堪重任;一裁两审的单轨劳动争议体制不仅造成公共资源的浪费,其高昂的经济成本和时间成本也使劳动者望法兴叹。因此, 我国劳动争议处理体制必需重构,建立适合我国国情的调解机制,选择“两裁终局”作为解决劳动争议的体制模式。
Lots of defects exist in current system settling labour disputes. Labour Disputes Mediation committee not taking actual effect , the first prelection for labourers almost failing. The one-sided labour disputes system, the one-arbitration-two-judgements system, not only brings about waste of public resources but also sets laborers beyond legal protection due to high costs in terms of economy and time. Therefore, domestic system of labor disputes must be reconstructed. The mediation system adapting to national conditions must be established. Two arbitrations for final should be preferred.
