摘要
刑法客观主义学派主张罪刑法定原则与罪刑均衡原则 ,而这两项原则分别体现了刑法的形式正义与实质正义 。
The objectivist school of the criminal law advocate the principle of d efinition of crime and punishment by law and the principle of equilibrium betwee n crime and punishment. These two principles respectively embody the justice in form and justice in essence which is in keeping with the idea of fairness.
