摘要
本文对中国城市化进程中十分现实的农村土地发展问题进行了尝试性研究。作者分析指出 ,土地发展权是从土地所有权中分离出来的一种物权 ,是所有权人将自己拥有的土地变更现有用途而获利的权利。本文认为 ,农民集体所有土地发展权从法律和事实上是受到压抑的 ,从而使农民的利益受到某种程度损失 ,农民作为理性的“经济人”就会对此作出反应 ,并在条件许可的情况下以不同的方式进行抗争。最后作者对农民集体所有土地发展权的压抑与农民的抗争作了结论性的评价 ,并就制定有关政策提出了建议。
This paper deals with the pressing issue of the development of the land in the rural areas of China in the course of urbanization. The authors point out, after some discussion of the subject, that the right to land development derives from land ownership and it is the right to obtain profits by changing the conventional use of the land. The paper tries to argue that the farmers’ right to land development in China is actually depressed by law, causing the farmers to suffer some financial losses. Inevitably, they will react to it as rational individuals and resist to it in various ways when conditions permit. Lastly, the authors make some conclusive comments on the depression of the farmers’ right to land development and also on their struggle for the above-discussed right of farmers as a social group and offer some suggestions for making relevant policy.
