摘要
银监会监管信托业较之过去有很大进步,但仍未能体现信托业的本质,亦未能确立信托业在金融体系中的独立地位。要完善我国信托监管体制,必须重塑信托理念,在法律层面上明确认识信托财产所有权转移的本质特点,完善信托立法,加强信托法律体系的构建进度。
Compared with the past,it has made great progress in the supervising trust industry of bank supervision council,but it still can not reflect the essence of the trust industry and also can not establish independent position of the trust industry in the financial system. In order to perfect our country's trust supervision system,we should rebuild our trust concepts,understand the essential characteristics of passing of title of trust property definitely,perfect trust legislation,and speed up the construction of the trust law system.
