摘要
在公有水权基础上实行可交易水权制度涉及到三个重要环节 ,即水权的界定、水价以及水权运作规则和水资源管理 ,其中水权的界定是水资源市场形成和运行的前提条件 ,没有排他性水权的确立 ,水权的让渡和交易是不可能的。本文从产权经济学的理论出发 ,分析水权的清晰界定与水资源市场的关系 ,并在此基础上分析水资源利用中的各种水权关系 。
The practice of tradable water rights system on the basis of public water rights involves three essential aspects, namely, the definition of water rights, the price of water, and the operational principles of water rights as well as the management of water resource. Among them, the first is the precondition of the formation and operation of water resource market. Without the establishment of exclusive water rights, the release and trade of water rights would be impossible. Starting from the theory of property rights economics, the paper makes an analysis of the relationship between the clear definition of water rights and the water resource market. And on this basis, it discusses the various water rights relations in the utilization of water resource and points out that a further definition and clarification of water resource quota rights are new premises of the realization of water rights system.
