摘要
民法典超越时空的魅力表现在它能够适应现实社会的发展,完成时代赋予它的历史使命,而不是单纯地靠"权力"推进。时下,关于民法典制定的相关讨论没有切中时代挑战的核心问题和趣旨,而且我国学术研究状况尚不能为我们应对挑战提供充分的理论支持。中国民法典的制定应该建立在民族自豪感的基础上,通过更加深入而细致的研究之后,成为21世纪的里程碑。
The push power from the state can not foster the splendor of the Civil Code to go beyond the limitations of the times, which would enable it to accomplish the historical mission assigned and continue mediating with the changing society. By far, the discussions presented about the making of the China Civil Code are not targeting at the key issue of the challenges from the changing of the times, and Chinese academy has not made sufficient preparations from the theoretical perspective for the challenges yet. The making of the China Civil Code should be based on the national pride, and only after the thorough and detailed study can it be realized that the China Civil Code becomes a milestone in the 21st Century.
