University Authority's Power for Disciplinary Punishment:A Jurisprudent Analysis

摘要 高等学校是法律、法规授权的行政主体,它对学生实施的处分具有行政管理的性质。高等学校学生处分权是否具有可诉性,取决于学校的处分决定是否引起学生学籍的改变和身份的丧失,因此,将勒令退学、开除学籍这些严重影响学生受教育权的处分决定纳入司法审查的范围,符合《中华人民共和国行政诉讼法》、《中华人民共和国教育法》的立法宗旨、立法精神和发达国家行政法改革的趋势,也能有效地监督高等学校自主权的运行,保护学生的合法权益。 As administrative entities, universities and colleges have the power to take disciplinary actions against offending students, but the necessity for challenging such power depends on whether the university authority's decision of disciplinary punishment causes the change of student's registration status or identity. Therefore, the inclusion of such disciplinary punishments as ordering to leave school and expelling from school into the scope of judicial examination is not only in conformity with the principle of Chinese Administrative Procedural Law and Chinese Education Law and the reform trend of administrative laws in developed countries, but also effective for supervising the operation of university authorities' administrative autonomy and protecting students' legitimate rights and interests.
