摘要
"都市计划容积移转办法"为我国台湾地区1998年仿效日本、美国的先例而创设。所谓容积移转,即允许都市计划限制发展的建筑物容积转移到许可发展的基地上,由许可发展的基地所有权人给予受限制基地所有权人相当的补偿。该办法属旧城改建中容积权利补偿的典型市场模式,将容积权利作为土地产权不可或缺的构成部分加以周全保护,符合近代西方民主国家土地政策的根本目的。因而,对我国城市房屋拆迁补偿合理化也有一定的借鉴意义。
'City Planning and the Transfer of Building Volume Act' was enacted by Taiwan government in 1998 after having drawn inspiration from Japan and USA.'The Transfer of Building Volume'which means transferring the building volume from limited development land to permitted development land and redressing for it, is a typical market model of compensation for volume right in reconstruction of old cities. Regarding the volume right as a necessary part of land ownership is accord with the demands of land policy in modern democratic nations, so, it is also a reference for rational compensation for house removing in Chinese cities.
