摘要
森林生态效益补偿的法律制度是协调森林资源经营者和受益者之间的利益关系 ,为林业发展提供稳定的资金来源的重要保障。这一制度已在我国法律、行政法规、部门规章和部分地方法规中得到体现 ,但其法律体系还很不完善 ,不能适应社会经济发展的需要。该文在分析森林生态效益补偿的法律地位的基础上 ,借鉴国外的生态效益补偿的成功经验 ,提出了完善我国森林生态效益补偿的立法措施。
Legal institution of compensation for ecological benefits of forest is an important guarantee for coordinating the benefit relationship between the op erators of forest resources and the beneficiaries as well as for steadily provid ing funds for forestry development. The institution manifests itself in the stat e laws, administrative decrees, department regulations and some local rules in C hina, though, the legal system is still far from perfection and cannot meet the demand of social and economic development. By analyzing the legal status of comp ensation for ecological benefits of forest and referring to the practices and ex periences of other countries concerned in the respect, the paper puts forward so me measures for legislatively perfecting the compensation for ecological benefit s of forest.
