摘要
黑社会性质组织作为有组织犯罪的一种形态,既不同于一般犯罪集团,也不同于典型的黑社会组织.应当在准确界定社会性质组织的概念和科学分析当前犯罪态势的基础上,重新审视其构成要件,划清与其他有组织犯罪形式之间的界限.在认定黑社会性质组织时,客观要件上应注意其行为的多样性和复杂性;主体要件上应注意其组织严密性和成员众多性,其构成人教至少应当3倍于一般犯罪集团成员底数;主观要件上应当引入犯罪人格的分析.在遏制黑社会性质组织犯罪的总体战略中,对其重点打击的'圈'不宜划得过大,'稳、准、狠'的方针中,关键在'准'.
As a kind of organized crime,organizations with underworld society nature differ from normal crime groups and typical underworld society.We should reexamine the requisites to constitute the crime of these organizations and differentiate them from other organized crimes on the basis of defining its concept and analyzing current situation of this crime.When we determine that an organization has underworld society nature,we should pay attention to the objective requisites including the acts' diversity and complexity and the subjective requisites including its well-organized nature and lots of members.It is important to make sure of our striking scope for achieving our aim.
