摘要
长期以来,政府作为公路建设投资主体,并作为国有企业所有者的代表,其行为能力必然使公路建设成为一个背离市场规律运作的垄断性行业而产生种种“官商”弊病。BOT投资方式是公路交通建设改革最为有效的途径,并能有效地解决政府投资的资金“瓶颈”问题。近几年我国公路基础建设引用国外资金的BOT投融资方式,愈来愈凸现出其重要作用;而国内民间资本被排除在外。在我国的实践中,引入外资的BOT投资方式通常令政府承担了过大过多的责任和风险。鼓励和支持国内私人资本以BOT投资方式参与公路交通基础设施建设,改变公路基础设施建设项目的投资主体,以引入真正的市场机制,更能从根本上革除“官商”所产生的种种弊症,并应加快建立和完善BOT投资法律体系,弱化政府的保证责任风险。
For a long term, in China, the government in highway construction is the principal part, and also is the representative in national enterprises. The government’s action ability would lead to monopoly which deviate from the market rules and lead to all kinds of official business. The BOT project is the most effective way in the reform of highway communications construction and can solve the bottle-neck problem of funds for the department, while the native capital is excluded. BOT project always bring too much responsibilities and risk for our government. Encourage and support private capital take part in the construction of highway communications by BOT, change the main body of investment to induct real market mechanism can abolish those faults of official business radically. At the same time, the law system of BOT project should be set up and consummated to feeble the government’s assurance risk.
