摘要
法律的道德性问题是法哲学的基本问题,是分析实证主义法学与自然法学之间长期争论的焦点。分析实证法学主张道德与法律是可分的,法律和道德没有必然联系。自然法学认为道德与法律不可分,法律本身应该合乎道德。在法治建设中,法律的道德性要求立法的道德基础、守法的道德义务以及司法的道德判断。
The morals and law are the two important kinds of social standard to adjust people's behavior and keep the civil order. The relation of the two is the basic problem of law philosophy. The analytical positivist jurisprudence and the natural law science disputes about morals, But it has important practical meanings to realize the ruling by law at the present in our country.
