摘要
我国教育法制建设有较快发展 ,但教育领域的权利救济存在诸多问题。从权利救济的相对面———法律责任来看 ,在教育公权力与私权利的博弈中 ,教育公权力的不适当运用和外儒内法的传统文化观念 ,阻却了法律责任的实现。从形式上看 ,它是行政法结构失衡的一种类型。教育法律责任设定上的严重滞后、粗糙 ,人格权保护的缺位以及立法权限的不清和位阶低下是教育法律责任难落实的法律层面的原因。
There are many issues on relief of right in the realm of education though legal system in China has been developing since 1978.From the responsibility of view,the term opposite to relief of right,the unfit application of public power in education and traditional ideas hinder the implementing of legal responsibility at the game of public power in education versus the people's right.From form,it also is a kind of structural imbalance in adminstrative law .The problems on enactment of responsibility ,such as lag,roughness,and the miss of right for personality as well as the vague of legislative authority and inferior degree ,are the reasons why responsibility in education is hard to be fulfiled currently.
