摘要
法律翻译历来被认为是对译者要求最为苛刻的一类翻译,但是随着法律翻译理论和实践的发展,法律翻译者正在逐步改变过去所扮演的被动角色,在翻译过程中拥有了更大的主动性和自由度,甚至成为法律的共同起草者。本文以中国大陆的法律翻译为主,从中国法律翻译入手,结合西方多语立法国家的法律翻译理论与实践,对译者在翻译过程中所享有的创造性问题进行了探讨。
Legal translation has long been regarded as one of the most rigid types of translation and legal translators merely mediators betweenthe text producers and receivers. However, with the development of the theory and practice of legal translation, legal translators are nowgradually converting their passive role in the communication process into an active one, even emerging as text producers with new authority andresponsibility. This paper looks at some aspects in this process of conversion and explores the extent to which legal translators can be creativewith language while preserving the unity of the single instrument. The main focus is on how legal translators on the Chinese mainland, intranslating the laws of China, take advantage of the freedom within their authority to deal with aspects such as the conversion of syntacticstructures, the use of passive voice, and deletions, etc. It also examines the latest theoretical developments in legal translation in plurilingualcountries and regions, as well as the new role assumed by legal translators in those jurisdictions.
