摘要
到目前为止, 法律并未就土地承包合同的基本原则作出完整的规定, 论者亦见仁见智。从综合分析法律与经济的关系的角度, 可将其归纳为以下五个基本原则, 即: 坚持土地公有、稳定家庭承包的原则; 法律与政策相结合的原则; 当事人意思自治与行政管理相结合的原则; 切实保护承包方, 主要是农民的合法权益的原则; 合理利用土地资源, 注重可持续发展的原则。
Up to now, basic principles basic principles of the land contract laws have not stipulated with details ,scholars have different views on it.By analyzing the relations between law and economy, the author considers that ,in the land contract ,there exists the following five basic principles ,namely, the principle of keeping land possessed by the public; the principle of laws closely connected with policies; the principle of the executive adminstration closely connected with the parties' autonomy ; the principle of really protecting the contractors' , primarily peasants' legal rights and interests; the principle of properly utilizing the land resources and paying more attention to the lastable development.
