摘要
契约自由是现代契约法的基本精神。但随着社会的变迁,有的学者认为契约已经满足不了现代社会的发展要求而衰落。因此需要将契约自由置入一种关系契约理论的背景之下重新审视和定位。
Freedom of contract is fundamental spirit of modern contract law. With social vicissitudes, some scholars deem that contract theory is declining because it can not meet the need of modern society. So we should survey and orient the theory of freedom of contract again, putting it in context of contract theory of relations.
