摘要
新商标法的实施,对加强商标管理发挥了巨大作用,但其立法的缺漏和理论上的争议依然存在,表现在商标权与商标专用权的概念界定、商标侵权的归责原则、以及商标淡化等方面。商标权与商标专用权的含义不同,但在立法中却是作为同义语来使用的,其侵权行为的归则原则是一个突破于传统民法理论的混合原则;另外,在侵权界定时应将淡化侵权行为明确于立法当中,以做到司法统一。
With the new trademark law implementing,it has a great effect on the brandmanagement,but,the legislative lacks and the theoretic disputes are still being,which manifest on the aspects such as the definitions between the trademark right and the right of trademark for a special purpose,the principles of imputation,diluting actions,and so on.Penman thinks that it is different in the meanings between thetrademark right and the right of trademark for a special purpose,but it is synonymy in the legislation,and the tortuous principles are admixture;In addition,the diluting actions should be prohibited in the legislation with the aim of judicatory unification.
