摘要
欧美反规避立法各有特点,反规避措施适用的对象各不相同,相关程序也有繁有简。在反规避措施适用的范围方面,欧盟远远广于美国;适用反规避所涉的机关,欧盟也较美国多。我国应借鉴欧、美及邓克尔文本的有关规则的合理内容,完善我国的反规避立法。
The rules of anti-circumvention of the EU and the USA have their own characteristics respectively. In terms of the scope to which anti-circumvention measures apply, the EU far exceeds the USA., and in terms of the organization,the EU also surpasses the USA. The objects to which anti-circumvention measures can apply differ and the related procedures differ in complexity. Therefore, we should learn from the EU, the USA and the reasonable content of related rules of the Dunkel Draft Text to perfect China's anti-circumvention legislation.
