摘要
本文认为刑讯逼供主要是因为侦查人员自身素质不高、破案能力低 ,对侦查权制约不够、监督不力 ,侦查人员对法律精神理解不透等原因造成的。要遏制刑讯逼供 ,应当从提高侦查人员的素质、提高破案能力及完善制约。
This paper takes a study on the main reason of extorting a confession by torture. There are the low diathesis and poor abilities to solve a case of deterctive personnel, little restriction for the right of inspect, not enough intendance, deterctive personnel misunderstanding entirely the legal spirit. For keeping within limits of it, we should improve the diathesis of deterctive personnel, the ability of cracking a criminal case, the comprete steps of intendance and so on.
