摘要
采取实证分析的方法,从宪政的角度和诉讼结构的角度剖析我国检察机关的真实面貌。我国检察机关的法律地位体现在其与执政党、权力机关、行政机关、审判机关以及当事人的关系上。根据现行法律规定我国检察机关的法律监督职能主要是一种诉讼法律监督的职能。我国检察机关的特征包括法律监督机关的定性、接受党的领导及同级人大监督、检察院作为整体独立行使检察权等方面。
The true visage of China's procuratorial organ is demonstrated from aspect of the constitutionalism and procedural structure by using positive analyzing method.The relationship between procuratorial organ and the Party,the organ of state power,the adjudication organ and the accused person embodies its legal status.The legal supervision function of China's procu- ratorial organ is primarily a procedural legal supervision function.The procuratorial organ has the features of the nature of legal supervision organ,under the leading of the Party and the surveillance of the people's congress of same level,and independence of the procuratorial organ as a whole.
