摘要
从表象上看,反垄断法是对知识产权滥用行为的规制,而其实质则是以建立公平的市场竞争环境为立法目的,从宏观上消除知识产权的权利行使障碍,进而为知识产权提供保护。在新的经济形势下,制定、完善反垄断法的相关制度对保护本国知识产权具有不可低估的作用。
From the appearance, the antitrust law is regulating abuse conducts of intellectual property rights. Essentially, it aims at establishing a fair market competition environment, dispelling the barriers of intellectual property rights and protecting it. In new economic conditions, it is of great significance to make and perfect antitrust laws to protect China's intellectual property rights.
