摘要
公正是当前学术研究的热点问题,但对公正概念本身却论说寥寥,缺少系统、深入地研究,而这恰是解析公正难题的起点。很难想象,一种真正严密无可辩驳的理论能够不以严密的概念分析为基础。通过考察公正的适用对象发现,公正(被定义概念)=相称(种差)+正当(邻近的属概念)。公正是人们在社会交往中利益“相称”的正当关系(或行为)。“正当”是其质的规定;“相称”是其量的规定。“正当与相称”体现了公正范畴之历史性和客观性的统一。
Justice is a hot question of the present academic research. However,there is little expounding to the concept of justice itself and not much systematic and deep research in it,which is just the starting point of analyzing the difficult problem of justice. It is very difficult to imagine that a kind of really tight and indisputable theory is not analyzed on the basis of the strict analysis of the concept. Through investigation of the just suitable target it is found that just (the defined concept) equals match (a kind of difference plus right (neighboring belonging concept). Justice is right relations (or the behaviors) of the interests “matching” in people's social contact. “Right” is the regulation of its quality. “Matching” is the regulation of its quantity. And “right” plus “matching” reflect that history and objectivity of the just category are unified.
