摘要
法的理念是对法的基本立场和追求的最抽象、最概括层面上的认识。市场经济条件下的市场失灵与政府失灵孕育了经济法,经济法从其诞生之初便是一种和谐取向,发展则是经济法的终极追求。和谐与发展作为经济法的核心理念,有利于提倡经济民主,推行经济宪政,同时也提示了经济法与民法和行政法的质的差异。
The idea of law is the understanding about the basic standpoint and pursue of the law on the most abstract and general level. On the condition of market economy, the failure of market and government gives birth to the economic law. At the beginning of the economic law, it took the harmony tropism, and the development becomes the last pursuit of it. As the core idea of economic law, harmony and development are beneficial to advocate economic democracy, carry out economic constitutionalism. At the same time, the idea delineates the essential differences among the economic law, civil law and administrative law.
