摘要 教育惩戒权是教师惩戒违反学校学习生活规范的学生的权力,它产生的人性动因是惩恶扬善;它不断得到发展的制度背景是“官师合一”;它的社会心理认同是私权公权化,是家长“教令权”想当然转让为教师惩戒权。从法理上讲,教育惩戒权应当属于委托性权力,应从法律上予以规制。 The right of educational punishment is a right that is used by teachers to punish students who has violated the rules in school life. The humanity motivation of its appearance is to punish evil-doers and encourage people to do good. The system background of its development is“the combination of authority and teacher”. Its social and psychological background is to make private right public right, to make the “right of education and command”of the parents change into teachers' right of punishment. Seeing from nomology's point of view, the right of educational punishment is a kind of trust right and should be standardized by the law.
