摘要
诉讼调解是我国多元化纠纷解决机制中的一项重要制度。近几年,人民法院在构建和谐社会的重大历史背景下,重新审视诉讼调解在维护社会稳定方面的独特功能,开展了以加强诉讼调解工作,规范诉讼调解程序为目的的诉讼调解制度改革,取得了显著的成效。进一步完善诉讼调解制度应以构建和谐社会为指针,树立以"司法为民"为指导的调解理念;修改民事诉讼法,补充制定相关司法解释,关注法律的实施。
Lawsuit mediation is one of the important systems in multiple dispute-resolving approaches in China.In recent years,the People's Court,in accordance with the drive to construct a harmonious society,has reexamined the unique role of lawsuit mediation in maintaining social stability and implemented reform to consolidate the lawsuit mediation,standardize the mediation procedures.In addition,the construction of a harmonious society shall become the guideline for the lawsuit mediation,and 'all for the people' shall be the basic principle.The civil procedural law shall be amended to contribute to the execution of relevant laws.
