摘要
当前我国法律体系中已经包容了许多崭新的法律制度。但是这些制度的社会实际效果如何,却没有得到有效的实证检验。因此,有必要尝试通过精心设计的社会调查,对制度的社会实效做出具有经验实证价值的结论。鉴于“双倍赔偿”制度的某种典型性,可以对其社会实效进行调查,以期在上述思路方面有所突破。
Many brand-new legal systems have already existed in our current legal framework, but how thesesysterns function in society has not effectively been tested. Therefore a well-designed social investigationcan be a better way to test the actual effects of the systems. Due to the distinctive feature of “double indemnity” system, this article attempts to make a breakthrough in testing its effects in society.
