摘要
死刑废除已经是世界性趋势和国际公约的要求,我国刑法学界已在限制死刑上达成了一定的共识,但在死刑废除的论证上还存在诸多争议。德里达对死刑的解构有助于死刑废除。死刑在关系到社会基本公正实现的同时也影响到社会的基本功利的实现,当其不再是为社会公正的基础或主要方面时,便是其被废除之日。
Abolishing death penalty has already been a world trend and a common require of international conventions. Although most of scholars agree on controlling the application of death penalty, there are many disputes on the demonstration of abolition of death penalty. The deconstruction of death penalty made by J. Derrida is useful for abolition of capital punishment. Death penalty is not only related to realization of social just, but also social utility, and when the capital punishment cannot be regarded as the base of social just or main aspect any longer, it should be abolished.
