摘要
2004年9月,党的十六届四中全会在《中共中央关于加强党的执政能力建设的决定》中指出,构建全体人民各尽其能、各得其所而又和谐相处的社会,是巩固党执政的社会基础和实现党执政的历史任务的必然要求,从而将构建和谐社会放在同经济建设、政治建设和文化建设并列的突出位置。构建民主法治、公平正义、诚信友爱、充满活力、安定有序、人与自然相处的和谐社会,离不开法制的建设与保障,尤其是离不开劳动法制的建设。劳动者是社会的主体,劳动者劳动权益的实现和保障是构建和谐社会的关键,要充分保障劳动者的劳动权益就必须加强和完善劳动法制建设。有鉴于此,本刊特邀请各领域的专家就劳动法领域的基本理论、基本制度以及相关热点问题撰文,以期进一步推进劳动法制研究,促进和谐社会的构建。
In September 2004, it is put forward in the ‘Decision of Improving the Construction of CCP's Ruling Ability by CCP's Central Committee' that to establish the harmonious society is the need of strengthening the social base and realizing the historic responsibility of CCP's ruling. So to establish a harmonious society is as important as economical construction, political construction and cultural construction. To establish a harmonious society can not be separated from the construction and security of law, especially the construction of labor legality. Realization and security of the labor right are the key of establishing a harmonious society. The construction of labor legality must be strengthened and perfected in order to safeguard the labor rights. So some famous legalists were invited to discuss the basic theory, basic system and some conspicuous question of labor law to propel the research of labor legality and accelerate the construction of harmonious society.
