摘要
从方法论的视角对法律研究进行分类,主要存在两种范式,即内部视角;形式主义与外部视角;工具主义。形式主义完全忽视了法律的社会约束与社会压力,陷于法律自治的乌托邦;而工具主义则忽视了法律的自主性。布迪厄的场域理论为克服这两种视角的局限提供了方法论的工具,本文提出用布迪厄的场域理论来进行法理研究并探讨了具体的运用策略。
There are two main paradigms in classifying the law study from the methodology angle, that is, the formalism inside and the toolism outside. The formalism neglects the social constraints and pressures falling into the law autonomy utopian, while the toolism is the opposite. Bourdieu＇ s field theory has provided the methodology to overcome the shortcomings of the two paradigms. This text suggests studying laws in the Bourdieu＇ s field theory and discusses the specific strategies which are applicable.
