摘要
我国城市房屋拆迁制度存在一些缺陷,表现在立法层级、拆迁目的、法规内容、权利救济四个方面。重构城市房屋拆迁制度,需要从改变立法观念,提高立法层级,完善立法内容,明确救济途径等方面进行。
There are some systematical defects in the urban building demolition which are reflected on the aspects of legislations, demolishing purposes, stipulations and right compensations. Therefore, it is necessary to change the legislation concepts, improve legislation criteria , develop legislation contents and clarify compensational measures so as to reconstruct the demolishing system of urban buildings.
