矿山污水治理的排污权交易制度设计

摘要 矿山开采过程中常常伴随着环境排污,其中又以污水污染较为严重。排污权交易制度将市场机制充分地运用于环境资源的配置,在总量控制的前提下,通过排污权的交易,实现低成本治理污染,有利于环境保护和经济的可持续发展,因而比政府行政管制手段具有更大的优势。论证了我国可以在矿区实施排污权交易,并根据我国的国情,设计了包括立法、信息公示、监控系统、总量控制、排污权的初始分配和市场交易等6个方面的排污权交易制度,最后提出了一些有待解决的问题。 Pollution always happens during mining process, particuarly the sullage. Sullage - drainage power trade system that fully exerts the market mechanism on the collocation of environmental resource, realizes low - cost pollution management through trading sullage - drainage power under the precondition of controlling total amount, which helps to protect environment and maintain economic sustainable development, so it has greater advantages than the administrative commands of government. This paper demonstrates that sullage - drainage power trade can be conducted in mines of our country. According the situation of China, six aspects associated with the trade system are designed, including legislation, open information, supervision system, total amount control, original distribution of sullage - drainage rights and market trading. Finally some problems that need to be resolved are put forward.
