摘要
不当得利制度的功能和构造也经由社会的演进、理论的发展和立法的变迁而被赋予更新的内容。不当得利制度在我国表现在立法中,条文设计极其简略,没有可操作性。故而对不当得利的法律构成、法律效果及法律研究进行探讨。
The function and structure of the improper reward system is entitled to newer connotation in the process of social evolution, theoretical development and legislation change. The improper reward system manifests in the legislation in China, and its articles are extremely simplified and have no maneuverability. So the lawful structure and lawful effect and study are discussed.
