摘要
行政公益诉讼原告资格是引发行政公益诉讼的关键,起诉人是否具有原告资格决定着诉讼是否得以进行。原告资格作为最重要的起诉条件,实质上决定了行政公益诉讼对公民权益的保护程度。建立起授权任何公民、团体和检察机关为维护国家利益和社会公益而向法院提起行政公益诉讼的新型原告资格制度,已成为现实的需要。
The plaintiff＇s qualification is the key to start the administrative public welfare litigation. As the most important factor, plaintiff＇s qualification essentially resolves the protec- tive level of citizen＇s welfare in the administrative public welfare litigation. It is necessary to build a new system of plaintiff＇s qualification which entities every person, group and public prosecutor to sue for national and social public welfare.
