摘要
国际制度的合法性基础在于其具有向国际社会提供公共物品的能力,能获得国际社会各行为体的赞同或同意。当今的国际制度如国际安全制度和国际人权制度就分别具有提供国际安全和人权保障等国际公共物品的能力,并且也能得到大多数行为体的赞同,但同时又在这两方面存在着较大的不足,这在一定程度上导致了国际制度的合法性缺陷。国际制度的合法性缺陷的根源体现在体制和文化两个方面。体制根源表现在主权国家的选择、决策程序以及监督和执行上的不同规定;文化根源体现在国际制度中的多元价值观冲突、核心价值观变迁以及不同行为体对相同价值原则的不同理解。国际制度的合法性缺陷不仅降低了国际制度提供公共物品的效率,而且还使行为体对国际制度的赞同受到极大的负面影响。
The legitimacy of international institutions is based on their capability to provide public goods and to secure the assent of the actors in the international system. However, international institutions are weak in both respects, which leads to a limitation in the legitimacy of international institutions. There are systematic and cultural sources for this limitation. The systematic sources are the different policy selections and procedures of sovereign states, while the cultural sources arise from the clash of the multi-values in international institutions, the transformation of the core values, and different understandings by the actors of the same rules and principles. The author argues that the limitation in the legitimacy of international institutions not only reduces their efficiency in providing public goods, but also has a serious negative impact on the actors’ attitudes toward international institutions.
