摘要
关于产品责任的精神损害赔偿,学者间争议颇多。自《最高人民法院关于确定民事侵权精神损害赔偿责任若干问题的解释》出台以来,争议有所平复,但仍存在一些问题。本文通过对国外立法案例的分析,阐述了《产品质量法》中有关精神损害赔偿立法的成就与不足,并提出了相应的立法建议。
There exist many disputes about spirit damage＇s compensation for products liability. After the “supreme court＇ explanations about some problems of spirit damage＇s compensation for civil pirate” was promulgated, the disputes are released. However, some problems are still existing. The article points out the improvement and limitation of regulation about spirit damage＇s compensation in “products quality law：” and gives some legislation suggestions.
