摘要
离婚经济补偿制度对于提升家务劳动的社会价值,保护对家庭做出较多贡献一方的合法权益,具有十分重要的意义。但同国外离婚救济制度相比较,我国的离婚经济补偿制度在理论设计上还存在不足,实践中可操作性不强,立法目的实现的预期效果不能令人满意。因此,应完善离婚经济补偿制度的立法设计,使之更具可操作性。
The economic consideration system in divorce has very important meaning to promote the social value of house work as well as to protect the legitimate rights and interests of those who devote more to the family. But compared with foreign divorce remedy system , there existed insufficiency on the theory design of the Chinese economic consideration system in divorce , and the effectiveness is not strong in the practice as well as the anticipated result of the realization of the legislative purpose is unsatisfactory . So the goal pursued of this article is to perfect the legistlation design of the economic consideration system and make it have more effectiveness.
