摘要
环境的污染与破坏是当今社会人们普遍关注的重大课题。环境犯罪的刑事立法体现了一定价值追求。本文通过对新旧刑法关于环境犯罪立法的比较,指出环境犯罪立法应以生态价值为核心,对我国刑法典关于环境犯罪相关问题进行探讨。为实现这一价值目标,对现行刑法典的体系提出构想,对法条规定提出若干设计。
The environmental pollution and destruction is a significant problem, which draws great attention. The legislation of environmental crime embodies the pursuit of value. The paper makes a comparison between the old criminal law and the current criminal law, points out that the key is the emphasis on ecological value, and discusses the relevant problems of environmental crime in criminal law. In order to fulfill the goal of the value, the paper proposes some suggestions on the system of criminal law and regulation of several clauses.
