“犯罪体系”是为了制作和完善刑法总则而存在的。“共犯论是体系论的试金石”,“犯罪体系”是随着有关共犯论的现实需要而变迁的,不存在超越历史和社会的不变的“犯罪体系”。提倡“从问题的思考转向体系的思考”,努力探索使各个事案的结论达致妥当的犯罪体系。
The meaning of ＂crime systems＂ lies in formulating and perfecting the general provisions of the criminal law. ＂The theory of joint crimes is the touchstone to the thenry ,of the systems＂, crime systems,＂ change with realistic need of the theory of joint crimes, theme, is not any ＂crime system＂ which not only transcends histories and ,societies but does not change. Advocating＂one chang from thinking of questions to thinking of systems＂, make great efforts to probe a crime system which makes the conclusion of each case proper.
