摘要
医疗合同是一种无名合同,从合同法发展趋势来看,主要表现在对合同自由的限制和诚实信用原则对合同法的影响,考察医疗合同的种种特征,不难发现这种趋势在医疗合同上的体现,从而有必要站在合同法发展趋势的高度把握医疗合同的本质。
A medical contract is a kind of implied contract.In the light of development of contract law, the tendency of imposing restriction on freedom of contracting and of applying the principle of good faith is very obvious.Observing all the features of medical contracts, this tendency can also be easily found.Therefore, it is necessary to take into account the tendency of contract law development to grasp the essence of medical contracts.
