摘要
对行政立法制度实施控制,是行政法治的基本要求。其中通过程序的设置对行政立法进行过程控制尤为必要。建立“公正优先,兼顾效率”的行政立法程序模式,是实现对行政立法权有效控制的必然选择。要实现行政立法程序公正与效率的价值追求,行之有效的民主参与和立法公开将是目标实现的制度保障。
To control the administrative legislation is the basic requirements for rule by law, among which the establishment ofprocedure becomes especially necessary. To establish a pattern of the procedure of administrative legislation, which takes priority for justice, giving consideration to efficiency is a certain choice to realize the efficient control of the power. In order toachieve the values of justice and efficiency of procedure of administrative legislation, effective democratic participation of thepublic and the open process of the legislation is the systematic safeguard.
