摘要
中国目前正大力加强完善食品安全法制。一方面是分段监管为主,品种监管为辅的体制已经确立,另一方面是《中华人民共和国农产品安全法》已列入2006年立法计划,《中华人民共和国食品安全法》的草拟工作也正在进行之中。法治建设推动食品安全法理论成为法学研究的重要课题。为此,本刊约请武汉大学法学院博士研究生、中国计量学院法学院王艳林教授主持承担的国家质量监督检验检疫总局“食品生产加工环节质量安全法律法规及其配套体系”课题组的部分教师,围绕中国食品安全法体系的构建和行政监管权的配设中如何吸收、借鉴外国暨国际成熟经验和行之有效的制度,撰写了本组文章,以期引起学界的关注并作深入的探讨。
China is now enforcing the perfection of law of food safety.On one hand,the system made up of principally supervision by steps and subordinately supervision by assortment has been set up.On the other hand,the safety of agricultural products quality in China has been listed into the 2006 legislation plans,and the draft of the law of food safety in China is being carried out,too.The theory of strengthening the legal system to advance the law of food safety has become an important issue in law research.Therefore,we invited part of the teachers in the law school of China Institute of Metrology who had undertaken the issue of 'safety law of food processing segment quality and its related systems' which was advanced by the General Administration of Quality Supervision,Inspection and Quarantine of the People's Republic of China.Revolving around not only the construction of Chinese food safety system but also how to absorb and learn from foreign mature experience and useful systems in allocating the power of administrative supervision,so we arrange this group of articles.All the discussion and criticism from educational circles are welcome.The group of researching safety laws of food processing segment quality and its related systems is led by professor Wang Yanlin,and the group is made up of 11 young teachers from the law school of China Institute of Metrology each of whom majors in different subjects.This group of articles is part of the earlier stage achievements.The report on the issue has been handed to the department of law and regulations of General Administration of Quality Supervision,Inspection and Quarantine of the People's Republic of China,and for this the department of law and regulations held an examining and commenting meeting in Xiao Mountain from 23rd to 26th February 2006.35 people,including the officers from the department of law and regulations in the general bureau,the department of law enforcement and the department of food supervision,as well as the front-line experttype leaders dealing with food safety and supervision in bureau of technical supervision in Zhejiang,Jiangsu,Fujian,Hainan,Liaoning and so on,discussed the task seriously,strictly and incisively.According to the suggestions and advice during the discussion,the researching group is forming the ultimate report.
