我国发展房地产投资信托基金的法律思考 被引量:9

摘要 近年来,我国房地产业发展迅猛,但在发展过程中一直遭遇着资金不足、融资渠道狭小等问题。房地产投资信托基金最早出现在美国,并逐渐在世界许多国家开展,近几年来亚洲一些国家也相继引入,并得到了良好的发展。我国也可以考虑开展房地产投资信托基金,以解决房地产资金缺乏问题,并向投资者提供新的投资渠道。本文将围绕房地产投资信托基金的基本概念和特点,在我国开展房地产投资信托基金的必要性,及在我国发展所面临的法律障碍进行探讨,并结合我国的实际情况提出建议。 In recent years, real estate industry grows rapidly, but it has always been facing bottleneck questions such as shortage of capital, lack of financing method. Real Estate Investment Trusts (REITs) originated in America and has been developed in many countries. In these years, it has also been gradually introduced into some Asian countries and prospers there. Practically speaking, it can also consider developing REITs in our country to resolve the question of short of capital, and provide new invest instrument to investors. This paper will introduce the basic concepts and characteristics of REITs, explain the necessity of developing it in China, analyze the legal obstacles encountered by us for such purpose, and try to bring forward practical and workable suggestions.
