摘要
西蒙斯案件的最终宣判使其成为2005年美国最具国际影响的案件。该案件集中反映了在美国联邦最高法院审理案件的过程中,各种形式的民意参与以及民意对案件审理结果的巨大影响。在美国司法体制中,法庭之友制度、陪审团制度和法官的自由裁量权的三维组合使得民意能够充分地引入司法过程中,与司法达成一个和谐的状态。国际舆论的压力也在案件审理过程中起到重要作用,并成为一种趋势。
The final sentence of Roper V. Simmons came out in 2005, which was the most important and most influential case in America. This case closely reflected all kinds of public opinions and their big influences on the final sentence during the course of the Supreme Court judgment. In American justice system, friends of the court, the jury and the common law system have taken public opinions into the judgment. There is a harmonious cooperation between public opinions and the court. The press of international opinions had also vlaved an important role in this case. which seems to he a trend in the future.
