摘要
保障生态移民的合法权益,是落实科学发展观、构建和谐青海的需要。作为生态移民,除享有宪法和法律赋予的各项权利外,还应享有因迁移而派生的补偿权、居住权、发展权、知情权、参与权、监督权、申诉救济权、再教育权、社会保障权、习惯权等权益。为了保证生态移民的各项权利落到实处,就要将移民工作纳入法制化的轨道,积极探索新时期移民工作的新思路。
To ensure the legal rights of eco-immigration is a requirement of fulfilling scientific development and building harmonious Qinghai. As being eco-immigration not just have the various rights that given constitution and law, but also should have the rights that derived because of migration, such as compensation rights, inhabitation rights. development rights, recognition rights, participation rights, supervision rights, appeal and relief rights, reeducation rights, social guarantee rights and custom rights and so on. In order to ensure eco-immigration＇s various rights to be fulfilled, the immigration work have to be put on the road of legalization and actively explore the new thinking way about immigration work of new period.
