特殊教育立法问题研究——人文关怀的视角 被引量:46

Research on Legislation of Special Education——from the Perspective of Humanity

摘要 2006年“两会”期间,特殊教育倍受关注,立法的呼声越来越高。特殊教育的发展常常与法的制定有密切联系,特殊教育立法极大推动着世界各国特殊教育的发展。大力发展特殊教育,确保残疾人受教育权的享有和实现,离不开法律的保障和支撑。本文以人文关怀的视角,在考察特殊教育立法的历史进程、分析我国特殊教育立法现状的基础上,阐释了特殊教育立法的法理基础,并提出和阐明了特殊教育立法理念、基本原则、基本制度,促使特殊教育事业进入法治的轨道。 Special education is paid much attention to and more and more people call for its legislation during the period of NPC and CPPCC in 2006. Development of special education is closely related to legislation and leg islation of special education gready puts forward special education' s development in each country all over the world. Developing special education and guaranteeing disabled people's educational rights and its realization need the assurance and support of laws. This article illustrates nomological foundation of special education legislation, proposes ideas, basic principles, and basic regulation of special education based on reviewing historical process of special education legislation and analyzing current situations of special education legislation in our country from the perspective of humanity so that special education can be guaranteed by legislation.
