摘要
“买一赠一”在市场经济的确立之初起着积极作用,但它的弊端却显而易见。对“买一赠一”从法律上进行定性分析显得尤为重要。“买一赠一”的买卖行为与赠送行为密不可分,赠送行为服务于、从属于买卖行为。这两个行为是同一合同之内容。赠品不符合法律规定或合同约定的质量条件,适用违约责任。赠品因缺陷致他人遭受财产、人身损害,属于侵权责任,可以适用《产品质量法》的有关规定。
The"buying one and getting one free" is a means of promoting the sale of goods. In this essay, the rationality, positive role and obvious drawbacks of the means are pointed out. Meanwhile, its legal character is analyzed, Finally, the author suggests taking effective measures to normalize the legal liability of commercial presents by better legal rules.
